The Enforcement Directorate (ED) has levied a penalty of ₹3.44 crore on BBC World Service (WS) India for contraventions of the Foreign Exchange Management Act (FEMA). Additionally, three directors—Giles Antony Hunt, Indu Shekhar Sinha, and Paul Michael Gibbons—have each been fined ₹1.14 crore for their roles during the period of violation.
The ED initiated its investigation following surveys conducted by the Income Tax Department at BBC's New Delhi and Mumbai offices in February 2023. These surveys were prompted by allegations of non-compliance with transfer pricing rules and potential profit diversion.
In September 2019, the Department for Promotion of Industry and Internal Trade (DPIIT) issued a press note capping Foreign Direct Investment (FDI) in digital media at 26% under the government approval route. However, BBC WS India, a company with 100% FDI, continued its operations without reducing its FDI to the mandated 26%, thereby violating FEMA regulations.
A BBC spokesperson stated, "The BBC is committed to operating within the rules of all countries we are based in, including India. At this stage, neither BBC World Service India nor its directors have received any Adjudication Order from the Enforcement Directorate." The spokesperson added that they would "carefully review any order when it is received and consider next steps as appropriate."
This development underscores the Indian government's stringent enforcement of FDI regulations in the digital media sector. Entities operating in this space must ensure compliance with the 26% FDI cap to avoid similar penalties.
